Rule 16
Decision of review
:
(1) In the application given for review according to rule 15, the distributor shall consider the following matters and make a decision:-
(a) whether the assessment of penalty or damages and compensation is based on facts,
(b) whether the grounds taken in assessing the penalty or damages and compensation have been proved or not,
(c) The assessment of fines or damages and compensation is improper, insufficient or insufficient.
(2) The distributor may consult with the expert on the subject related to the fault while making the review decision.
(3) The distributor may decide to cancel or annul the fine or damages and compensation given to the person who applied for review, or to reduce the number of such fines or damages and compensation.
(4) According to sub-rule (3), the file containing the decision shall be sent to the relevant investigation officer within seven days from the date of the review decision.
